Orthopedic Surgery Expert Witness


Orthopedic surgery experts manage patients with disorders of the musculoskeletal system, including fractures, deformity and tumors.  They are experts in trauma, wrist injuries, and sports injuries.  Orthopedic surgeons often sub-specialize in specific areas such as joint replacement, spine, and extremity.  Within the spine specialty, they may manage spine diseases, including deformity, degeneration, fractures, and tumors.  Many have additional expertise in congenital abnormalities, spine lengthening procedures, and arthritis.

A case one of our orthopedic surgery experts recently consulted on involved a boy in California receiving allegedly negligent treatment by a radiologist and family doctor after he sustained injuries while playing soccer.


Our orthopedic surgery expert assisted the plaintiff’s attorneys in reviewing the plaintiff’s medical records and personal injury case files.  After the plaintiff was injured playing soccer, he went to an orthopedic physician who took his x-rays, and prescribed him pain medication.  The doctor followed the plaintiff’s recovery progress for approximately seven months, and prescribed the plaintiff more medication and therapy during his outpatient visits.  After seven months of outpatient treatment, the plaintiff’s medical providers completed a MRI, and the results were read the following month.


The MRI results found a fracture in the plaintiff’s hip, but his family doctor advised him to keep walking, and told him his injuries would improve.  Instead of healing, the fracture necrotized.  The plaintiff developed advanced necrosis, and required hip surgery and bone scraping.  This medical procedure left the plaintiff with one leg shorter than his other, and the leg permanently stationary.


After receiving the plaintiff’s medical records, our orthopedic surgery expert evaluated the case for legal merit.  For the plaintiff to establish medical malpractice, he had to prove four elements:

• His medical provider owed him a duty;
• His medical provider breached its duty by not complying with the reasonable standard of care in the medical community;
• He was injured;
• The medical provider’s breach caused the plaintiff’s injury


Within 10 days of receiving the potential medical malpractice case materials from the plaintiff’s attorneys, our reviewing physician provided conclusions to the attorney on the case merits.  Our orthopedic surgery expert found negligence by the radiologist and family doctor. 


At the time the boy complained of left hip pain immediately after his soccer injury, his x-rays were abnormal and showed early slipped capital femoral epiphysis.  A follow-up CT scan of the left hip confirmed this diagnosis.  Nine months after the patient was first injured, a diagnosis of his fractured left hip was made and recorded, but he was provided no treatment for this until about three months later.


The plaintiff did not receive a referral for orthopedic treatment until after about a year passed since he first sought medical treatment.  The referral to orthopedic treatment included pin fixation.  Had a referral been made a year earlier, it was likely the progressive slipped capital femoral epiphysis would have been pinned in situ with less deformity to his leg. Had a referral been made seven months after his injuries, the plaintiff could have avoided a three month delay in definitive treatment.
